Making a Will and the issues which doing so raises is a subject which does not normally attract much media attention. However, a BBC2 programme broadcast during January and February 2011 and the recent reporting of other cases have put the subject firmly to the fore.
On 9 October 2007, the Chancellor announced changes to the Inheritance Tax ("IHT") regime affecting the way in which the Nil Rate Band ("NRB"), one of the principal reliefs from IHT, may be claimed. The changes will affect married couples or civil partners only and will only come in to effect in respect of deaths on or after that date.
Lasting Powers of Attorney are now the appropriate vehicle for ensuring that decisions relating to your Property and Financial Affairs or Health and Welfare can be taken by relatives, friends or professionals appointed by you should that become necessary.
Parents or grandparents may want to include trusts in their Wills which prevent a person they want to benefit becoming entitled to assets outright, for example until they attain a specified age, or only have the benefit of assets during their lifetime. We can advise on the structure of the trusts and also whether there may be any ongoing inheritance tax charges.
