Health and Safety

The team acts for clients in the defence of criminal proceedings brought by the HSE relating to industrial injury and death; to advise on accident investigation, evidential and disclosure obligations, directors' personal liability; to undertake risk assessment, compliance and policy reviews. We further advise clients on civil liability issues where damages are claimed following death or injury.

  • Death of employee due to ejection of blade from woodworking machine
  • Death of construction worker following fall from ladder
  • Serious injury sustained by engineer working on a fairground ride
  • Several cases involving serious injuries due to falls from defective scaffolding on building sites

Environmental

Representation in Environment Agency prosecutions such as pollution of watercourses; breaches of environmental and waste management regulations; noise and air pollution issues; advise on compliance.

Significant cases:

  • Prosecution arising out of the pollution of a watercourse by a Construction Company
  • Investigation by Environment Agency of pollution due to farm waste entering stream
  • Investigation by Environment Agency of pollution due to petrol leaking from a tanker
  • Defence of proceedings brought against waste management companies for breach of waste management licence regulations

Food law

Denison Till also advises in Trading Standards investigations and the defence of prosecutions of such issues as food hygiene and handling; labelling; false or misleading trades descriptions; due diligence.
