unfair dismissal

If you have been dismissed by your employer for what appears to be an unfair reason or if statutory minimum procedures were not followed, you may be entitled to claim unfair dismissal in the Employment Tribunal.

One year's service is required to claim unfair dismissal, though in certain circumstances (for example, if the dismissal contravenes discrimination legislation) one year's service is not necessary.

A failure to follow the minimum procedures introduced on 1 October 2004 can render the dismissal automatically unfair and could result in an increase in compensation to the employee of up to 50%.
