maternity & parental rights

All female employees are entitled to 26 weeks maternity leave regardless of length of service. Maternity pay and the entitlement to a further 26 weeks additional maternity leave depends on length of service.

It is unlawful for an employer to discriminate on the grounds of pregnancy and employees who are subjected to less favourable treatment may claim sex discrimination.

In addition, there are entitlements to adoption leave and pay and paternity leave and pay. A number of criteria must be met for the entitlements.

Finally, there is an entitlement to unpaid parental leave, subject to the age of the child and notice provisions.

If you are unsure of your rights, or believe that you have been discriminated against, the employment department can help.
