It causes employers considerable concern when a key employee leaves to join a competitor.
Such concern is heightened when the employer learns the employee cannot prevent the employee from joining the competitor or contacting the employer's clients/customers. Restrictive covenants are needed to protect the employer's legitimate business interests and expert advice is needed when drafting such clauses. If they are too restrictive, the Courts will not enforce them because they constitute a restraint of trade.
