Employers may encounter redundancy situations for a whole host of reasons. Trade may have declined, a restructuring may be necessary or advances in technology may result in the need for fewer employees.
Whatever the reason, handling the redundancy process with extreme care is paramount in limiting unfair dismissal claims. Failure to comply with a fair procedure (including the minimum procedures set by the Employment Act 2002) may prove costly. Employees with over 2 years' service are entitled to a statutory redundancy payment. The employment department has extensive experience in advising in relation to both individual and large-scale redundancies, where additional obligations are imposed on employers making 20 or more redundancies within a defined period. The department can assist in identifying a redundancy situation and advise on the necessary procedural steps to take, such as selecting those to be made redundant and the consultation obligations.
