Discrimination legislation is a minefield. Employers need to ensure that they get it right as, unlike unfair dismissal, compensation is uncapped.
Discrimination on the grounds of sex, sexual orientation, race, religion/belief, disability and age is unlawful under UK law. Employers may be liable for the discriminating acts of its employees unless reasonable steps have been taken by the employer to prevent such conduct. This would include having equal opportunities and harassment policies and providing the necessary training. In addition, the employment department is on the Disability Rights Commission's panel for employment advice. The department offers expert advice in relation to all areas of discrimination in the workplace, including drafting the necessary policies and providing the relevant training.
